Back in October I posted here that on how the Seventh Circuit had misconstrued the law of unjust enrichment. Fair and balanced fellow that (I believe) I am, I hasten to post a lnk to a more recent case where the court got it right: Carroll v. Stryker Corp. I'd be the first to admit that this was the easier case; a discharged employee cannot recover in quantum meruit when there's an employment contract. Perhaps the difference also lies in the difference between the two judges; Richard Posner, the self-identified guru of law and economics and Diane Sykes, Marquette Law School grad and former Wisconsin trial court judge.
