One of the best aspects of going to this morning's oral arguments in the RadLAX case before the Supreme Court was visiting with counsel for the petitioner (the debtor in bankruptcy), David Neff. I know David from years ago when I practiced bankruptcy law in Milwaukee. David was with a Chicago firm and we worked with and against each other on several cases. A great guy and an excellent attorney.
One of the more regrettable parts, however, was watching David take it on the chin from every member of the Court save Justices Thomas and Kennedy. (Justice Kennedy recused himself just this morning.) Not that anyone was unkind but it was clear the debtor's arguments had not found much traction with any member of the Court.
Does Las Vegas book bets on Supreme Court decisions? Are there over/unders on voting? If so, I'd put my money on the respondent lenders at 8-0.
